Complaints Against Motorized Vehicles

The International Trade commission has received a complaint against certain Motorized Vehicles and Components Thereof.  The complaint alleges Tariff ACt of 1930 section 337 regarding the importation into, sale for, and sale within the United States of certain motorized vehicles.  The respondents named are Mahindra and Mahindra Ltd of India and Mahindra Automotive North America Inc. of Auburn Hills, MI the requested actions in the complaint only include a limited exclusion order and a cease and desist order.  Comments are invited from proposed respondents, interested parties, and members of the public.    The comments that will be most relevant and of interest to the Commission:

  1. Define how the subject articles are used in the United States.
  2. Identify concerns of the impact regarding Public heath, safety, or welfare
  3. Identify similar or directly competitive articles made in the United States which could replace subject articles if excluded.
  4. Determine whether possible competitive or replacement suppliers could match volume of subject respondents.
  5. Review how remedial orders would impact United States consumers.

Significance

It is important to see if the remedial orders impact would be of a negative influence to large and active supply chains within the United States.  Lost of access to supplies for United States manufacturers, could affect markets participants.

Mahindra is a supplier of tractors between 20 and upwards up to 110 HP, and multiseater Utility Task Vehicles (UTV),  and other small motorized vehicles between $15,400 and $90,000.  These products are used for agriculture, homeowners, professionals, landscaping, ranch operations, farming, livestock, grounds maintenance, industrial, material handling, rural area maintenance.  John Deere deals and sells over 150 products, including tractors between the Horsepower range of 22.4 up to 113 Horsepower.  Cost is similar between $13,999 United States Dollar (USD) and up.  Caterpillar also sells tractors and utility vehicles.  Either of the two companies could match higher volumes.

Entrepreneurs hoping to enter into a venture that requires a UTV as necessary equipment, could be impacted by this complaint should further actions be taken.  There are equivalent suppliers that supply different products and therefore should remind equipment purchases should receive a good amount of research prior to purchase.
